| Hi guys,im in a dilemma as to what to do.Sorry this post maybe long winded. Some of you may already know i had a paint stallion that i sold to a top breeder over here.Well this is the story. The person that brought him who we will call anon for now.well anon already had half share in lyle in exchange for training fees as we agreed.I then asked if anon would like to buy my half of lyle out.Anon agreed but said he couldnt afford to pay any cash out as they were in the middle of building a big arena complex.I said ok in that case how about in exchange for training fees on another of my horses.This was agreed. the horse i sent was skittles who was already broken in but just needed schooling.He was there 3 months and in that time my daughter only got to ride him twice as 1 it was so far away to get to and 2 anon was busy. Well on 1 of the occasions we went up there poor skittles mouth was red roar and his frogs were bleeding,now this horse is a very easy horse to do. My mistake at the time i didnt say anything again as i thought he was to busy with the arena going up that skittles was a rush job,i then arranged to pick skittles up and said to Anon could you pay me the difference from training skittles,rest money`s owed for lyle he said yes but could i wait awhile.I agreed. I have since sent several emails of which not 1 reply asking for my money and also several phone calls and messages of which he ignores.On the 1 occasion i got through he asked could i wait till he has sold some foals again i agreed,he has since sold 3 foals and still no money through. I got through to him 2 weeks ago explaining i need the money asap to pay shiraz`s vet bill,he said yes he will get something to me asap,guess what im still waiting. Now the real problem is i signed over lyles papers to him ages ago when this was all first agreed, (stupid i know)because of who he is and im a very trusting person i didnt think for one moment he would diddle me. We also didnt put anything in writing (again very stupid). Ive even said to him in an email that if boot on other foot he would have got his money ages ago.Of which he would. Ive now written him a letter,sent recorded post.Asking for my money in 10 days time if not i will come get lyle until he pays me what he owes. Am i right in going to get him??? Would i then get prosectued for stealing as he not in my name anymore even though he hasnt finished paying for him. What should i do? Stupid thing is there really is not that much left to pay on lyle considering the agreed amount we said he was worth.But to me its a fair amount. This Anon person is a well known breeder over here and well respected,im also afraid he will bring my little old name down.But surely these people cant get away with treating the little people like dirt. HELP!!!! | |

| I don't think if you have record of your emails/letters then it would be considered theft at least not here. I would be rip roaring mad dang it! You know people who enter into agreements verbal or otherwise and then take advantage of your good nature just to screw you over really burns my butt. Doesn't matter if they owe you $5.00 or $50,000.00 if they are trying to make things right that is one thing but to blow you off with a gee Im sorry or Ill get to it hmmm yeah right. Someone who makes payments of even a small amount shows good intent but to not even return your calls or even try to make it right well that shows what kind of character you were dealing with. I feel sorry for your paint and glad that your other horse is out of there hope it is feeling better. I guess the only good thing from it all is you can chalk it up to one of those lessons learned/character building things- dang it don't you'd think we would eventually grow out of those? I seem to keep getting drawn into them myself too so don't feel like your the only one. | |

| im very,very ,very mad and whats worst still is he promised he would show him here and in Europe,Nope didnt even show him at the paint show held at his premises.Not even bred from him yet.Cant see why he still keeping him,he just left in stable 24/7 and that not a life.Lyle used to run with geldings when i had him.The only reason i sold him was i thought at the time that this guy had the resources to promote my boy and he would be wasted with me,How wrong was i.The poor boy is miserable. This has been going on since January,think ive been patient enough dont you? | |

| This is not that uncommon for some well known people in the business. There are many of them. That is why people trust them. There is one thing you can do. Look to see if he transfered the horse in his name.. If not put in for a lost registration NOW and then go get him. If he has transfered him you are stuck.. My guess is if he is that lame about taking care of business he has not done the transfer yet.. I would no let up on him either.. Sorry this happened. I never let a horse leave with out the money in my hand for this very reason.. | |

| CONTRACTS... I hate them but in this case it would have been a life saver. I bought a mare one time, at least I was suppose to. The deal was she was to be in foal. 60 days later still not in foal. Getting ready to bred her again for the 3 rd time and now being late June, I told them, I was no longer interested. They were going to take me to court. I said OK. Fine with me. No contract. I hated backing out on the deal but, she was not in foal. I wasn't buying her for a riding horse. My plan was to sell the foal to make up for the money out of pocket. I was nice and tried to tell them reasons but they wouldnt listen. There lawyer told them they had no case. I sold a horse, got 1000.00 down. 3 months later, she backed out of the deal. She had her lawyer call me and tell me they were going to sue if I didnt give the money back. She video'ed the mare being shown and her new trainer, wanting to sell her his horse, said the mare was lame. NOPE. Her lawyer said that her vet said it was. I had my vet watch the same video, he said no. So I told her lawyer my vets says the mare was not! Nothing ever came of it. I kept the money. period. We had a contract and I was more than ready trot off to court. The mare that was suppose lame, was shown at Congress in the NYATT. She had enough nerve to come and watch. Its horse trading, buying and selling. I hate it. Gosh, I have learned so much, been taken advantage of, but I still believe in trust. Just ever so often someone like this nut comes along and shows you not to trust. Send Cert. Letters stating you expect payment in full, or a contract needs to signed to set up a payment plan. Enclose it. Give him 10 days to comply, if you have not heard from him them, set the wheels in motion. BUT I do agree with Bluejay, check on the papers first thing. | |

| I don't have a current APHA membership, but they will give you information over the phone, even if you aren't a current member. I just called them to try to get the info for you and they are closed. If no-one here has a current membership, I'll be glad to call for you on Monday. | |

| All deposits are non refundable PERIOD.. If they change their mind they forefit the deposit. I would never return one.. And who knows if you let them go before they are paid for what really happens to them. The hardest lesson in my life is that what people say is not at all what they do.. | |

| They will tell you everything you ever wanted to know about that horse online but the current registered owner. Sorry. That would probably take either an email or a phone call sorry. He sounds like a nice horse. Pretty nice papers on him. | |
